1. Obtain Officer's Information
"For the record, may I get your name and badge number, please?"
2. Record Confirmation
"Officer [Name], is this encounter being recorded?"
- "Is your recording both audio and video?"
- "Is your equipment functioning properly?"
- "Is your body microphone and camera operational?"
3. Reason for Stop
"Officer [Name], what is the emergency and how can I help?"
"What facts or information gave you probable cause to stop me?"
4. Ask About Warrants
"Do you have a signed and issued warrant to search me or my property?"
If yes: "May I see it, please?"
5. State Your Non-Commercial Capacity
"For the record, I am not 'operating' in a 'for-hire' capacity or engaging in commercial use of the highways."
6. Clarify Status
"Am I under custodial arrest?"
"If not, am I free to go?"
7. Invoke Rights if Detained
- "Officer [Name], I feel threatened and unsafe. I do not consent to your actions."
- "I invoke my right to remain silent and my right to legal counsel."
- "I do not consent to provide documents or information that may incriminate me."
